General Terms and Conditions (GTC)

  1. Scope of Application

    1. These GTC apply to all contracts between the Swiss American Chamber of Commerce (hereinafter “SwissAmCham”) and customers (hereinafter “Customer”) regarding the booking of events and the purchase of books via the online shop at www.amcham.ch.
  2. Conclusion of Contract

    1. By submitting the order, the Customer makes a binding offer. The contract is concluded once SwissAmCham confirms the order by e-mail.
  3. Prices

    1. All prices are stated in Swiss francs (CHF) and include statutory value added tax.
  4. Payment

    1. Payment may be made either by advance payment (bank transfer) or by credit card (Visa, Mastercard).
    2. Advance payment: After confirmation of the order, the Customer will receive a payment request containing the bank details and payment reference. The order will only be processed after receipt of payment.
    3. Credit card: Credit card processing is carried out via the payment service provider Stripe, which processes the transaction securely and in encrypted form. The credit card will be charged at the time the order is placed. The order will be processed after successful authorisation by the card issuer. If payment fails, the order will not be carried out. Swiss AmCham itself does not store any credit card data. The payment service provider’s terms of use and privacy policy shall apply in addition.
    4. In both cases, performance of the service (shipment or event confirmation) will only take place after full receipt of payment.
  5. Delivery / Access (Books)

    1. Books will be shipped to the delivery address provided after receipt of payment. Shipping costs are indicated during the ordering process. Delivery periods are non-binding estimates.
  6. Event Bookings

    1. Event bookings will be confirmed by e-mail after receipt of payment. The right to participate arises only upon such confirmation. SwissAmCham reserves the right to cancel events if the number of participants is too low or for good cause; any amounts already paid will be fully refunded in such cases.
  7. Warranty

    1. The statutory warranty rights under the Swiss Code of Obligations (CO Art. 197 et seq.) shall apply.
  8. Liability

    1. Swiss AmCham’s liability is limited to intent and gross negligence. Liability for slight negligence, loss of profit or consequential damages is excluded to the extent permitted by law.
  9. Data Protection

    1. Personal data are processed in accordance with Swiss AmCham’s separate privacy policy and in compliance with the Swiss Data Protection Act (FADP).
  10. Applicable Law & Place of Jurisdiction

    1. Swiss law shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Zurich, Switzerland.
  11. Amendments to the GTC

    1. SwissAmCham reserves the right to amend these GTC at any time. The version valid at the time of the order shall be decisive.
